Following the announcement of DOE, the following actions will be taken under the new Upenn agreement:
- Upenn restores all Individual Upenn Division I swimming records, or similar perceptions, misappropriated by male athletes allowed to compete in the female category.
- Upenn issues an official statement University The community says it is Title IX compliant and specifies that Upenn does not allow men to compete in women’s athletic programs or occupy women’s intimate facilities at Penn Athletics.
- The statement specifies that Upenn adopts a biological definition of the words “male” and “female” according to Title IX, consistent with President Trump’s executive orders, “protecting women from gender ideological extremism” and “protecting men from female sports.”
- Upenn will post statements in prominent locations on its main website and each website for women’s athletics.
- Upenn will withdraw any guidance that violates Title IX, remove or modify internal and public statements or documents that are inconsistent with Title IX, and notify all staff and women’s track and field of any such resignation. and
- Upenn sends a personalized apology letter to each affected female swimmer.
Upenn also issued a statement acknowledging the contract and proposed that a change in swimming record would be made.
“Yesterday, Penn and the U.S. Department of Education’s Office of Civil Rights (OCR) resolved a February 2025 survey on women’s athletics Title IX compliance. This is a complex issue and we are pleased to have reached a solution through the standard OCR process to conclude a Title IX investigation,” the statement said.
“The policy for pens during the swimming season in 2021-2022 NCAA Eligibility Rules At the time of the Eligibility Rules, some student-athletes acknowledged that these rules were at a disadvantage. We recognize this and apologise to anyone who experienced competitive disadvantages and anxiety due to policies that were effective at the time.

US Secretary of Education Linda McMahon has confirmed Trump’s resolution.
“Thanks to President Trump’s guidance, Upenn has both apologised for past Title IX violations and agreed to both ensure that women’s sports are protected at university for a generation of future female athletes,” McMahon said in a statement.
“Today is a huge victory for women and girls not just at the University of Pennsylvania, but across our country. The department praises us for correcting past harm to women and girls.
Former Upenn female swimmer Paula Scanlan, the first teammate on the female team and the first teammate to oppose the school for allowing the situation to unfold, said she was “thank you” to Fox News Digital.

“I am deeply grateful to the Trump administration for its commitment to protecting women and girls and restoring legitimate admiration,” Scanlan said.

Today, it marks a critical step in repairing past abuses among female athletes and building a future where sexism does not limit the possibilities of girls.”
Of Thomas’ former teammates, Scanlan is not the only one who’s speaking out anymore.
