Judge Roberts temporarily frozen a lower court order from US district judge Paula Sinis, who ordered Maryland resident Kilmer Abrego Garcia, who was mistakenly sent to El Salvador by 12am on Tuesday, to be redirected to Trump administration.

The filing from Roberts comes after the Trump administration appealed a lower court decision Monday morning to both the Fourth Circuit Court of Appeals and the Supreme Court in anticipation of the appeals court’s decision.
A judge in the Fourth Circuit voted unanimously earlier in the day to reject the Justice Department’s request for administrative stay, clearing the way for the country’s Supreme Court to intervene.
The 11-hour suspension granted by Roberts gives the Trump administration extra time to comply with a court order requiring Abrego Garcia to return to the United States

Roberts ordered the case to remain “with the signatories or further orders of the court” and sought a response from the plaintiffs by Tuesday night.
Abrego Garcia’s lawyer responded immediately.
In a reply brief filed with the Supreme Court, Abrego Garcia’s lawyers noted the extraordinary circumstances surrounding his deportation.
“This case is one of them,” they told the court.
“Showing the government’s ‘extraordinary circumstances’, they added, there is a erroneous removal of Kilmer Armando Abrego Garcia to a foreign country that is not entitled to removal.”
“Abrego Garcia has never been charged with a crime in any country. He is not sought by the government of El Salvador,” they said. “He’s sitting in a foreign prison only At the request of the US as a product of Kafka-style mistakes. ”

The 11-hour intervention from Roberts comes as the Trump administration has undergone intense scrutiny over deportation flights to El Salvador.
