Westmoreland continued to question Bana about the balcony incident and the alleged injuries she took and photos of her.
“Mr. Combs didn’t cause you any injuries we saw on your phone… in the September 26th metadata,” she told Bana.
“I can’t agree with you,” she replied.

Westmoreland also asked if Bana told the government he was in MDMA, GHB and cocaine. Bana said, “I didn’t say those words.” She insisted, “It’s a lot of drugs,” and said she didn’t do it that night.
“The government knew or should have known that this testimony was perjured and it is possible that Mr. Bongolan was injured by Mr. Combs on a balcony in Los Angeles early on the morning of September 26th or the day before,” the letter demanding the mistial.
“The use of perjured testimony in regards to balcony cases is merely an example of the prosecution’s misconduct during this trial.”

The defense previously requested a false statement based on questions related to allegedly destroying fingerprints provided to the Los Angeles Police Department following the incident at home.

The six-time Grammy-nominated rapper testified that Diddy allegedly broke into his home. Kid Kudi also said he believes the dishonorable music mogul was involved in the car fire, leaving his Porsche damaged beyond repairs. According to Kid Cudi, both incidents occurred after Diddy learned about Diddy’s relationship with her on and off girlfriend Cassie.
