Trump administration lawyers appealed the order almost immediately.
Regardless of the court’s order, Judge Holmes admitted that her decision was likely merely an “academic exercise” as it is almost certain that Abrego Garcia will not be released.
She said the Trump administration had previously vowed that he would be taken to ice custody “being subject to anticipated removal procedures outside of the court’s jurisdiction.”

At a hearing Wednesday, Holmes ordered that Abrego Garcia be placed in home detention under the siblings’ control if released on Ice. If that happens, Abrego Garcia will be tracked using position monitoring such as ankle monitors.
