Biden’s appointee, Massachusetts District Judge Brian Murphy, ruled Tuesday night that the Trump administration must maintain custody of immigrants if they illegally control the removal and have to send them back to the United States.
Lawyers for illegal immigration from Myanmar, also known as Burma, and Vietnam have accused the Trump administration of illegally deporting clients to third-party countries. They argue that deportation violates Murphy’s previous court orders and requires immigrants to be given a “meaning opportunity” to establish that sending them to a third country would put them at risk.
