Apple has requested that the federal court of appeals temporarily suspend the district judge’s ruling and require that more competition be allowed. Apple App Storeclaims that if the decision is not suspended, it will cause irreparable harm.
District Court judges easily ordered Apple App developer restrictions After denializing Apple’s order issued in a 2020 anti-trust lawsuit brought by Epic Games, creator of the video game Fortnite.
Among them were the 27% rates Apple rated to app developers when they purchased outside the app store, and the locations where developers could view links for users to purchase outside the app.
The tech giant was filed Wednesday in the Ninth Circuit Court of Appeals, saying the district court’s order “permanently excludes Apple from requesting its property and controlling core aspects of its business operations, including protecting platform integrity and in-app purchase mechanisms.”

“These restrictions, which cost Apple a significant annual cost, are based on actions that have never been determined to be illegal (and not); rather, they were imposed to punish Apple for violating previous state injunctions that were ineffective in itself,” the company argued in its filing.

U.S. District Judge Yvonne Gonzalez Rogers said in her ruling that “Apple sought to maintain a billion-dollar source of revenue directly against this court’s injunction.”
