“On this basis, it is plausible that this evidence could, as the plaintiffs filed, reflect McMullen’s credibility, or Kroger’s corporate culture,” the judge said, adding that “it is impossible to weight it against relevance and proportionality without knowing the basis for embarrassment.”
He added that despite the “court modestness,” he would order McMullen to answer personally under oath.

After review, the court was able to grant McMullen’s request for a protection order and answer “only the eyes of the judicial.”
With an order on August 1st, McMullen was given for seven days to comply.
