“Plaintiffs are likely to succeed in the merits (and in fact they do),” Kogan added.
He went on to say that Haitians’ interests in living and working in the United States “far more than the potential harm to the US government.”
That being said, the government still has the freedom to enforce immigration laws and end the TPS status established by Congress.
Fox News Digital reached out to DHS to comment on the issue, but received no response by the time of publication.
