The investigation ended just three days later, and documents obtained by Fox News Digital showed that the investigator repeatedly accidentally dated the game on October 2nd.
As seen in the public records obtained by Fox News Digital, WFG attorneys who investigated the allegations against Fleming’s Tim Heaffee later offered to the school’s attorneys to help them navigate the federal Title IX investigation in the same situation. The offer was rejected.
Bock said the revelation “surprised” him.
“I was surprised to learn that WFG is representing MWC in the Brooke Slusser case, while also seeing that another lawyer from the company appears to be independently investigating attempts to hurt Brooke.
“Hiring WFG to perform such contradictory and mutually exclusive roles suggests that Commissioner Nevares and the MWC were not interested in discovering the truth. Instead, MWC has long focused on promoting the interests of SJSU and promoting the narratives that men should be allowed to compete with women’s sports locker rooms and women’s sports.
Bock asked the U.S. Department of Education to investigate the situation.
“The Fox News report works in parallel with MWC’s SJSU to promote transideology, harm female athletes, and hides the truth from the public. According to a Bock statement, he defended SJSU in a federal investigation into allegations that he appears to be “independent.”
“We hope that these shocking revelations of conflicts of interest will be fully investigated in reported investigations of SJSU’s actions, as we do not fully trust MWC. Certainly, this investigator could be a key witness in federal lawsuits against MWC and SJSU against MWC and SJSU, as he is advertising MWC due to concerns about employment and implementation cooperation against SJSU against MWC and SJSU, protecting women.”
Bock leads Slusser’s lawsuits against SJSU and Mountain West, leading a bigger lawsuit against the NCAA, led by former university swimmers and current “Outkick” host Riley Gaines.
Bock previously called the meeting’s investigation into Fleming’s allegations “something less than insufficient and thorough,” asking for evidence to be revealed.
There was no evidence revealed by the conference as Fleming finished the season, earned all conference honors and led SJSU to the Mountain West Championship Game. The trans athlete traveled to Las Vegas with her female teammates for a conference tournament in the final week of November.
After leading an investigation that resolved Fleming’s charges in November, Heafy contacted San Jose University Attorney Dustin May on February 6th to offer to help with the federal investigation. President Donald Trump just signed an executive order on February 5th to enforce his duties that had been entrusted to the presidency for a few weeks, and the following day, Trump’s Department of Education SJSU research About Fleming’s situation.
May declined to offer Heaphy on February 18th, but Heaphy replied the following day by writing, “Please tell me if you can help me in any way with this or other issues.”
None of the WFG lawyers have been accused of violating applicable professional conduct rules.
